Once signed up to Stabilis fitness Packages you must keep to our rules to get results.

  • Each session is 45-60minutes depending on goals, sex and age.
  • All programmess, training sessions and nutrition must be adhered too.
  • The instructor must be notified of any holiday periods so they can write a programme for you and the instructor will take 28 days’ rest period every year but will make sure programmes and nutritional plans are up to date.

Commitment and Attitude Agreement

I have volunteered to participate in a program of physical exercise under the instruction of Stabilis Fitness Personal Training Solutions. Training may include, but is not limited to, weight and/or resistance training, cardiovascular training, and floor mat exercises.

Stabilis Fitness Personal Training agrees to instruct, assist and train me.

I realise that a large portion of my success will be based on my commitment to follow instruction, changing my lifestyle, and my attitude towards the fitness program. Unfortunately, Stabilis Fitness Personal Training cannot guarantee results, but my willingness to work hard will improve the opportunity of success.

Late / No-••-••-••Show / Cancellation Agreement

Our main goal is to provide the best possible service to our clients.

Stabilis Fitness Personal Training works on an appointment based schedule to allow you the time required for your personal training session.

Sessions will generally be 45- 60 minutes. Please be on time for your appointments. If you are late for a session it will still end at the scheduled time. If you are more than 15 minutes late for a session, it will be considered a no-show and no refund or carried over session will be given.

 

CANCELLATION POLICY FOR COMMITMENT PACKAGES

  • DUE TO THE NATURE OF THE PROGRAMMES IF YOU DO NOT ATTEND THE SESSIONS NO REFUND IS GIVEN AND SESSIONS CANNOT BE CARRIED OVER.
  • ANY HOLIDAY PERIODS ARE TO BE DISCUSSED WHERE A PROGRAMME WILL BE WRITTEN FOR YOU TO TAKEAWAY.
  • THE TRAINER IS ENTITLED TO  28 DAYS HOLIDAY PERIOD Y E A R L Y
  • PRICES ARE REDUCED TO COVER HOLIDAY PERIODS FOR BOTH THE TRAINER AND THE CLIENT.
  • IF JOINING THE SEMI-PRIVATE TRAINING EACH PARTICIPANT MUST ATTEND THE SESSION TOGETHER AS   REFUNDS ARE   NOT    GIVEN FOR   MISSED SESSIONS.
  • ANY SESSIONS MISSED DUE TO ILLNESS ETC CANNOT BE CARRIED TO AN OTHERWEEK.

CANCELLATION POLICY FOR INDIVIDUAL SESSION PURCHASED 

  • A 24 HOUR CANCELLATION POLICY APPLIES TO SCHEDULED SESSIONS BUT MUST BE REBOOKED FOR THAT WEEK.
  • SESSIONS CANCELLED OR REARRANGED LESS THAN 24 HOURS IN ADVANCE WILL BE CHARGED IN FULL TO THE CLIENT.
  • IF A SESSION IS CANCELLED WITHIN 24 HOURS BY THE PERSONAL TRAINER, A COMPLIMENTARY SESSION WILL BE   OFFERED.
  • REFUNDS WILL NOT BE GIVEN DUE TO ILLNESS OR INJURY BUT CAN BE REBOOKED AND USED WITHIN THE WEEK UNDER EXCEPTIONAL CIRCUMSTANCES

Refund Agreement 

  • Money back guarantee applies to the commitment programmes if results both mentally and physically fail, but only if the client makes every session and doesn’t cancel  and keeps to 2 – 4 sessions e a c h week with the personal trainer and strictly follows the fitness and nutritional programme.
  • If a refund is asked for a £50 admin charge will be taken.

Payment Agreement

Commitment plans and single sessions will be paid in advance.

Stabilis Fitness Clothing Returns Policy

All our items are custom-designed and made to order, so we will only accept returns if we have made a mistake with the order, or if the item is faulty.

How to Return

When you receive your item, you must check it as soon as possible and return to us within 14 days. We can only accept items that are in new condition, unwashed and with all labels attached. Please use the returns address label attached to your invoice, and ensure to complete the returns form located on the reverse of your invoice and enclose in your package.

Please note we can not be held liable for any items lost in transit on the way to us. We advise that you return any items by a recorded service.

Wrong Item Received

We apologise if you have received the wrong item by mistake. This is not common and we want to resolve this as quickly as possible for you. To receive a refund or a replacement, you must return the item in the same condition you received it and within 14 days from the day on which you received the item. Once the incorrect goods have been received by our staff we will be able to rectify the issue. We will refund any return postage costs in this circumstance, please request a postage refund from our support staff.

Damaged or Faulty Items

Please accept our apologies if you have received an item that is damaged or faulty. We understand how frustrating this can be and want to resolve this as quickly as possible for you. If you believe that the item is faulty, please contact us. You will need to tell us exactly what the fault is and as soon as possible after discovering the fault and we will advise what to do next.

Our Returns Policy for faulty items upholds your statutory rights.

Item Not Received

We apologise if you have not received your item. This is not common and we want to resolve this as quickly as possible for you.

To receive a replacement, you must inform us that you have not received your item within 21 days from the day on which you received an email from us confirming that the item had been dispatched. Please note we can not issue refunds for lost items, only replacements.

Your Statutory Rights

Our Returns Policy does not affect your statutory rights. For more information about your other statutory rights, please visit the UK Government’s website at: www.direct.gov.uk or contact Consumer Direct, the Government funded consumer advice service on 08454 04 05 06.

What we’ll do Next

All products returned to us are checked by us.

If you are entitled to a refund then we will refund the price of your item (including the cost of delivery).

Returns are usually processed within 7 working days of receipt of a cancelled order, and at the latest within 30 days of receipt.

We will refund the original credit/debit card/PayPal account used to purchase the item.

Return of Replacement Goods

If an item you ordered was found to be faulty and we replaced it, you have the right to cancel your order in respect of the replacement product within 7 working days starting on the day after you received the replacement item and receive a refund.

Cost of Returning Items

Please note that we can only refund the postage costs for returning an item where:

  • we sent you the wrong item, or
  • the item is damaged or faulty; or

We will not refund postage for items found to be in good working order. Costs of posting the item back to you will depend on the item and will be communicated to you after the testing process has been completed.

General Terms and Conditions

These Terms and Conditions govern your use of the ‘Stabilis Fitness website (the “Company Site”) and your relationship with Stabilis Fitness’ (the “Company”, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use the Company Site. 1    Use of the Company Site

The Company Site is provided to you for your personal use subject to these Terms and Conditions. By using the Company Site you agree to be bound by these Terms and Conditions.  References to these Terms and Conditions include the Terms of Purchase of Personal Training.

2    Amendments

We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Company Site.  Any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Company Site. The changes will apply to the use of the Company Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Company Site. If you continue to use the Company Site after the date on which the change comes into effect, your use of the Company Site indicates your agreement to be bound by the new Terms and Conditions.

3    Stabilis Fitness Sessions

3.1  To participate in any activities you must be over eighteen years of age.

3.2  You must ensure that the details provided by you on registration or at any time are correct and complete.

3.3  You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.

4    Intellectual property

The content of the Company Site is protected by copyright, trade marks, database right and other intellectual property rights. You may retrieve and display the content of the Company Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Company Site or for sale from the Company Site without written permission from the Company.

5   Your use of the Site

5.1  You may not use the Site for any of the following purposes:

5.1.1  disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;

5.1.2  transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice;

5.1.3  interfering with any other person’s use or enjoyment of the Company Site; or

5.1.4  making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

5.2  You will be responsible for our losses and costs resulting from your breach of this clause.

5.3  Although we aim to allow you the best possible access to the Site, we make no promise that the services at the Site will meet you requirements. We cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to us via the contact form and we will attempt to correct the fault as soon as we reasonably can.

5.4  Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

6    The Company’s liability

6.1  The Company Site provides content from other Internet Sites or resources and while the Company tries to ensure that material included on the Company Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content.  If the Company is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.

6.2  If we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order.  Our liability shall not in any event include indirect or consequential loss, business losses such as lost data, lost profits or business interruption.

6.3  This clause 6 shall not limit or affect our liability resulting from any products or services sold through the Company Site being found to be unsafe or if something we do negligently causes death or personal injury. The Company shall not be liable to you for any indirect or consequential loss or damage including loss of earnings arising out of your participation in the sessions nor for an aggregate amount greater than the fee paid for the sessions.

6.4  You acknowledge that certain elements of the training sessions can be physically demanding and you are aware of the nature of the sessions and the associated risks involved.  As a condition of your enrolment, you agree that you are physically capable of participating in the sessions and accept full and complete responsibility for your own participation in the sessions. You agree that should any medical or physical condition arise prior to or during a session which is likely to affect your ability to participate in a session you will not attend / will withdraw from the session. Without limiting the foregoing, before taking part in any sessions you must complete a health questionnaire and if appropriate seek advice from your doctor.

6.5  You agree and acknowledge that, if required, it is your obligation to take out personal accident and personal items insurance and that it is your responsibility to store any valuables in a safe place when attending outdoor training sessions.

7    Third Party Websites

As a convenience to customers, the Company Site includes links to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such websites does not imply any endorsement of views, statements or information contained in such websites.

8  Advertising and Sponsorship

Part of the Company Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Company Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

9    Applicable Law

These terms and conditions and any non-contractual obligations will be subject to the laws of England and Wales.  We will try to solve any disagreements quickly and efficiently.  If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

10    International

Use We make no promise that materials on the Company Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Company Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this Site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

11    Miscellaneous

11.1  You may not transfer any of your rights under these Terms and Conditions to any other person.  We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.

11.2  If you breach these Terms and Conditions and the Company chooses to ignore this, the Company will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

11.3  We process information about you in accordance with our Privacy Policy.  By using our Company Site, you consent to such processing and you warrant that all data provided by you is accurate.

11.5 Stabilis Fitness accepts Visa and Mastercard

All payments that you make online via our website are powered by EasyCart and Stripe.

Apart from paying by credit or debit card, You can also pay by Bank transfer, Paypal, Cash or contact us for alternative arrangements. Payments are accepted in GBP Sterling only.

Data Protection

Security

  • Stabilis Fitness will not be liable for any failure by the card-holder making the payment to properly protect their details being seen by other persons or otherwise obtained by such persons during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.

Service Provider

  • The on line card payments are not collected by Stabilis Fitness directly but by the Payment Service Provider. We accept all cards except American Express.
  • The card-holder will receive an e-mail either confirming that the payment has been authorised by their card holding bank or declined.
  • All authorised payments will be posted back to the relevant client’s accounts or the areas that would be expecting the other income on the following day.
  • It is responsibility of the client to check with Stabilis Fitness that the card payment has been accepted.

Data Protection

  • The term ‘personal data’ is as defined in the Data Protection Act 1998
  • Stabilis Fitness will collect (or may already hold) the client’s personal data and that of the third party making the payment in accordance with its data protection policy.
  • By agreeing to these terms and conditions, the client and any third party making payment accepts and consents to their personal data being provided to the Payment Service Provider for the sole purpose of the Provider offering and administering the online payment facility to the client or the third party making the payment.
  • The client or third party making the payment is responsible for ensuring that all personal data provided to or held by Stabilis Fitness and /or provided to the Payment Service Provider is clear and accurate. Stabilis Fitness will not be liable for any losses suffered by the client or third party making the payment as a result of inaccurate information being provided either to Stabilis Fitness of the Service Provider.
  • Stabilis Fitness may use the personal information provided to it to contact the client or third party making payment, to clarify or resolve any issues that arise in connection with any online payment made in respect of the client’s accounts with Stabilis Fitness.
